Notice of Privacy Practices
This notice describes how medical information about you may be used and disclosed and how you can get access to this information.
Please review it carefully. This notice applies to your medical records and other protected health information held by Mountain Peaks Family Practice. Information collected through this website is covered separately by our Privacy Policy.
Effective December 1, 2026
Your information, your rights
Mountain Peaks Family Practice ("Mountain Peaks," "we," "us") is required by the Health Insurance Portability and Accountability Act (HIPAA) to keep your protected health information private, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.
"Protected health information" means information that identifies you and relates to your past, present or future health, the care you receive, or payment for that care. It includes your medical record, your membership and billing records, and messages you exchange with us through the member app or patient portal.
Mountain Peaks is a Direct Primary Care membership practice. We do not bill insurance for the primary care included in your membership. Even so, your records are protected under HIPAA and this notice in the same way they would be at any medical practice.
How we typically use or share your information
Treatment. We use your health information to care for you and share it with other professionals involved in your care. For example, when we refer you to a specialist, an imaging center or a laboratory, we send the records they need, and we receive their results back into your chart.
Payment. We use your information to manage your membership, to bill you for services charged separately from membership, and to collect payment. When a provider we refer you to bills your insurance, Medicare or Medicaid for their services, they do so under their own privacy practices. If you ask us to, we may share information with your insurer to support a claim you submit yourself.
Health care operations. We use your information to run the practice, improve the quality of care, train staff, and manage our systems, including the practice management and patient portal platform that powers the member app.
Other ways we may use or share your information
We are allowed or required to share your information in other ways, usually in ways that contribute to the public good. Before we share for these purposes we must meet the conditions set by law.
- Public health and safety: preventing disease, reporting adverse reactions to medications, reporting suspected abuse, neglect or domestic violence, and preventing a serious threat to anyone's health or safety.
- Research: only under conditions approved by an institutional review board or privacy board, or with your authorization.
- As required by law: including to the U.S. Department of Health and Human Services when it checks our compliance with federal privacy law.
- Organ and tissue donation and requests from medical examiners, coroners and funeral directors.
- Workers' compensation, law enforcement and other government requests: for workers' compensation claims, for law enforcement purposes or with a law enforcement official, with health oversight agencies for activities authorized by law, and for special government functions such as military, national security and presidential protective services.
- Lawsuits and legal actions: in response to a court or administrative order, or to a subpoena.
- Business associates: companies that provide services to us, such as our practice management platform, must agree in writing to protect your information to the same standard we do.
- Family, friends and others involved in your care: when you agree, or in an emergency when you cannot tell us your preference and we believe sharing is in your best interest. We may also share information in a disaster relief situation.
- Appointment reminders and health information: we may contact you to remind you of appointments, to follow up after a visit, or to tell you about treatment options and services that may interest you.
Your rights
When it comes to your health information, you have certain rights. Here is a plain-language summary.
- Get a copy of your medical record. You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. We will provide a copy or a summary, usually within 30 days of your request, and may charge a reasonable, cost-based fee as permitted under Utah and federal law.
- Ask us to correct your record. You can ask us to correct health information you think is incorrect or incomplete. We may say no, but we will tell you why in writing within 60 days.
- Request confidential communications. You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address. We will honor all reasonable requests.
- Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment or operations. We are not required to agree, and may say no if it would affect your care. If you pay for a service or item out of pocket in full, you can ask us not to share that information for the purpose of payment or operations with your health insurer, and we will agree unless a law requires us to share it.
- Get a list of those with whom we have shared information. You can ask for an accounting of the times we have shared your health information in the six years before your request, who we shared it with and why. We will include all disclosures except those about treatment, payment, health care operations, and certain others such as any you asked us to make. We will provide one accounting a year for free and may charge a reasonable, cost-based fee for additional requests within 12 months.
- Get a copy of this notice. You can ask for a paper copy of this notice at any time, even if you have agreed to receive it electronically.
- Choose someone to act for you. If you have given someone medical power of attorney, or if someone is your legal guardian, that person can exercise your rights and make choices about your information. We will make sure the person has this authority and can act for you before we take any action.
- File a complaint if you feel your rights are violated. See Questions and complaints below. We will not retaliate against you for filing a complaint.
Your choices
For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations below, talk to us and tell us what you want us to do, and we will follow your instructions.
- Sharing information with your family, close friends or others involved in your care.
- Sharing information in a disaster relief situation.
- Contacting you for fundraising efforts. We do not currently fundraise; if that changes, you may opt out.
If you are not able to tell us your preference, for example if you are unconscious, we may share your information if we believe it is in your best interest, or when needed to lessen a serious and imminent threat to health or safety.
Our responsibilities
- We are required by law to maintain the privacy and security of your protected health information.
- We must follow the duties and privacy practices described in this notice and give you a copy of it.
- We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time by letting us know in writing.
Breach notification
We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information, as required by law.
Changes to this notice
We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available on request, in our office, and on this website.
